The primary goal of the dissertation is to examine the potential of administrative law for the development of Public Private Partnerships in Bulgaria. The thesis focuses on the legal instruments required for enhancing the protection of public interest. The author represents a new theoretical framework for the analysis of Public Private Partnerships in the context of Bulgarian administrative law, as well as new practical solutions for improving the legal regime. The first part of the thesis explores the origin and nature of Public Private Partnerships. The second part of the thesis makes a critical review of the existing Bulgarian regulation of concessions and institutionalized PPPs. The detailed legal analysis discovers conceptual flaws, as well as many logical and technical deficiencies in the concession law. The regime of public private joint ventures is also subject to vigorous criticism mostly for the lack of publicity and transparency in the selection of private partners and projects. The third part of the thesis delineates the territory of administrative law in the PPP regulation with a view to protection of public interest. The proposals de lege ferenda include adoption of new PPP law, introduction of new institutes of administrative law, such as public debate for defining public interest in the preparatory phase of PPP procedure; compliance certificate for public interest, subject to judicial review; "administrative clauses" in the PPP contracts; administrative control over the conduct of the public partner in the PPP project; PPP public register etc.
