The work represents the first monograph on a wide range of issues related to the criminal law protection of the Bulgarian cultural heritage. It explains some of the basic notions of the positive law regulation of the cultural heritage preservation. The analysis contains the historical and comparative law aspects of the regime of preservation of cultural heritage in Bulgaria and substantiates its conservative character. The monograph argues that a separate group of crimes against cultural heritage preservation should be differentiated. Their specific object of crime is further explained. Other significant issues regarding the general characteristics of these crimes are also discussed. A systematization of the crimes against cultural heritage preservation is proposed in regard to the public interests harmed. Furthermore, various corpus delicti are analyzed in light of the specific problems that arise in the theory and practice of law enforcement. Concrete proposals are made for a comprehensive criminal law regulation of this group of crimes as well as for improvement of the positive law regulation of the cultural heritage preservation. |
